Anyway,
You live a peaceful and private life, something happens, and you get a court summons.
You didn't hurt anyone or damage any property, but the STATE wants to throw the book at you.
You intuitively know that punishment would be unjustified but you don't know how to express yourself in court.
MISTAKE #1: You get a lawyer, at best they tell you to take a plea deal, and they ignore all your concerns about your rights.
Why won't a lawyer help you?
Here's why:
CJS Volume 7, Section 4 - "Attorney & client: The attorney's first duty is to the courts and the public, not to the client, and wherever the duties to his client conflict with those he owes as an officer of the court in the administration of justice, the former must yield to the latter."
This means that lawyers are officers of the court and cannot do what you can do, they MUST stick to "procedure" which involves ignoring what’s most important to you.
But the court is a FIDUCIARY of your rights, they work for you, for the purpose of protecting your rights, but they get around this when you relinquish yourself to an attorney who works for them.
Some may realize this and may decide to express themselves in court without a lawyer. Bravo.
MISTAKE #2: You show up to court without having filed anything, effectively waiving most of your rights without you even knowing it.
Why must you file things beforehand?
If you do not file anything beforehand then it is seen as though you implicitly agree with everything that is happening;
Silence is acquiescence.
You must file very simple documents to the court to protect yourself, and you MUST do so before making an appearance. If you fail to do so, and if you show up making a general appearance, you've already waived most of your rights without even knowing it. (Also, skipping court is the worst thing you can do.)
What must you file to protect your rights?
1. Plea in Abatement (Challenge Jurisdiction, Lack of Due Process)
2. Special Appearance
3. Sworn Testimony and Reservation of All Rights
4. Show Cause (A demand for the prosecutor to show cause why the case should not be dismissed for reasons stated.)
These things alone will make the court take you very, very seriously. The prosecutor may just drop the case because they don't want the headache. Though, they may have a canned response and try to wiggle out of the hot seat you put them in.
This is where your education comes in and you object to their statements as baseless and irrelevant to your pleadings.
If you have not hurt anyone, if you have not damaged any property, if you have not created a victim or any injured party, then these strategies will put you in the strongest position possible. Even if you make enough mistakes to where a judgment is made against you, these strategies will be what you need to win in an appeal (a higher court).
