I do not mediate gift card transactions because it is impossible to determine the cause of disputes when a buyer claims a card is empty or the code is invalid. There are three possible scenarios:
1) an issue with the card itself;
2) the buyer is a scammer who drained the card's funds and is attempting to scam the seller; or
3) the seller is a scammer who provided an empty card from the start.
As a mediator, I lack the knowledge or evidence to make an informed decision.
AilliA's Mediation Instructions
1. **Initiation of Mediation**
- The initiator (Buyer or Seller) must privately message AilliA, the mediator, with the trade terms and the counter-party's username, before using the automatic XmrBazaar system for multisig handling.
2. **Listing Requirements**
- For physical goods, the Seller must provide a complete description, including images, on the listing page.
- For services, both Buyer and Seller must have a complete agreement in place before starting mediation. The agreement should outline the services provided, satisfactory outcomes, and should be included with the mediation application.
3. **Funds Confirmation**
- Once funds are received in the generated multisig wallet, AilliA, the mediator, will confirm the transaction with both parties.
4. **Shipment Documentation (Physical Goods)**
- Before shipping physical goods, the Seller must:
- Take a photo of the item with a handwritten note including the Buyer's XmrBazaar username, trade price, and date.
- Take a video of packaging.
- Take a photo of the sealed package and shipping label, and timestamp the images.
- Both buyer and seller must agree on what to do in case of confirmed loss in transit by the shipping service (USPS, UPS, FedEx, etc.) and inform AilliA, the mediator. (It's advisable for more valuable goods to use a tracking number and at least basic shipping insurance.)
Note: Proof of delivery is ONLY required to be provided to the mediator, AilliA, in the event of a dispute. Failure to provide this proof can adversely affect the decision made by the mediator when resolving the dispute. Both parties are encouraged to retain these records until the transaction is fully completed and both parties are satisfied, to ensure a smooth resolution process in case of any discrepancies.
5. **Documentation (Services)**
- Both the Seller and Buyer of services must document all processes and be ready to provide photo/video/code repository, and other relevant proofs to the mediator in case of dispute.
- Buyer and Seller are encouraged to negotiate any disputes before requiring mediator's intervention.
- In complex dispute cases requiring prolonged time to review (e.g., watching long videos or reviewing codebase), the mediator's fee will increase to 20%, thus encouraging both parties to act in good faith and do their very best to negotiate disputes with each other.
6. **Funds Release**
- After the Buyer accepts the goods or the service is confirmed by both parties, the mediator will release the funds (minus the Monero network's transaction fee and mediator's fee) to the Seller.
7. **Dispute Resolution (Fake/Wrong Goods/Empty Packages)**
- If the Buyer receives fake, wrong goods, or an empty/dummy package, the Buyer must immediately inform the Seller and mediator, providing relevant photo/video proof. Making unboxing videos of sealed packages is advisable in all cases.
8. **Unfaithful Behavior**
- In case of dispute and proof of unfaithful behavior of a party (Buyer or Seller), that party will be added to a blacklist and banned from xmrbazaar.com.
**Important Precautions**
- **Fiat-to-Monero Exchange:** Be aware of chargeback risks when using payment services like PayPal, Square Cash, or Venmo. The mediator cannot minimize this risk.
